JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 Petitioners apprehend their arrest in connection with Gogari P.S.Case No. 310 of 2018, G.R.No. 2564 of 2018, registered under Sections 341, 323, 354, 504/34 of the Indian Penal Code and Sections 12, 18 of POCSO Act.
Allegation against the petitioners is that they dragged the informant inside bushes and tried to outrage her modesty and also assaulted her.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they are students.
Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that the girl was minor. Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.1176 of 2019(2) dt.17-01-2019 2/2 circums4tances, let petitioners surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
