JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2019 This is an application for grant of anticipatory bail in connection with K. Hat P.S. Case No. 03 of 2013, disclosing offences under Sections 302/34 of the Indian Penal Code. Allegation as per F.I.R. is that the informant is running a Khatal near Judicial Colony Purnea and the accused persons came to Khatal and asked the brother of the informant to come for a party and thereafter when the informant enquired on phone from his brother Bittu @ Uday Shankar Singh, he informed that he is celebrating party and the petitioners are also present and later on, on the next day at 07:10 A.M., he received information that his brother Bittu @ Uday Shankar Singh has

Submission of learned counsel for the petitioners is that police after investigation has not found the case true against these petitioners, but the cognizance has been taken against these petitioners and there is no enmity between the petitioners and the deceased.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K.
