2. The petitioner is in custody since 26.02.2014 in connection with Madhepur P.S. Case No. 31 of 2014 for the offences alleged under Sections 459, 380/34 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated on mere suspicion and no incriminating article has been recovered from his conscious possession of the petitioner. Petitioner has already been in custody for over one year.

4. Having regard to the nature of accusation with regard to the blow given by the petitioner with khanti as well as the fact that he was arrested on the spot and also the
