The petitioner is languishing in custody since 17.10.2014 in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
The accusation is of committing theft of tractor. The name of the petitioner sprang up on the confession of co-accused Ashok Yadav.
It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and similarly situated co-accused Buchan Singh has been granted bail vide Cr. Misc. No. 50197 of 2014.
Considering the aforesaid facts, let the above
Patna High Court Cr.Misc. No.4667 of 2015 (02) dt.05-02-2015 2/2 named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 51 of 2014.
Since the petitioner is accused in three other cases, the learned court below will cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions. (Dinesh Kumar Singh, J) DKS/- U T
