This appeal is directed against the order dated 23.05.2022 passed by 1st Additional Sessions Judge-cum-Special Judge, SC/ST, Aurangabad in connection with Daudnagar P.S. Case No. 108 of 2022, whereby and whereunder the prayer for grant of anticipatory bail to the appellant has been rejected. Learned counsel for the appellant submits that appellant has not committed any offence as alleged in the first information report and he has been falsely implicated in this case due to village politics. Patna High Court CR. APP (SJ) No.2043 of 2022(4) dt.25-02-2023 2/2 between the parties. The appellant has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, this Court is inclined to grant bail. The appellant, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge SC/ST Act, Aurangabad in connection with Daudnagar P.S. Case No. 108 of 2022 subject to the conditions laid down under section 438(2) of the code of Criminal Procedure. The impugned order is set aside.
