The petitioner seeks bail in a case registered under section 366A of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is alleged to have kidnapped the victim but the victim made her statement under section 164 Cr.P.C. and she disclosed that she was in love with the petitioner from before the occurrence. She was interested in marriage but she was not intending to go along with the petitioner before her marriage. Considering the fact that the victim herself admitted that she was in love with the petitioner and she solemnized her marriage with the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond

Patna High Court Cr.Misc. No.5053 of 2015 (2) dt.05-02-2015 2/2 of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of IIIrd Additional District & Sessions Judge, Naugachia in S.T. No. 797 of 2014 arising out of Gopalpur P.S. Case No. 130 of 2014.
