Taking note of this fact that petitioner is main assailant of the deceased and his trial is in full swing, I am not inclined to release him on bail and accordingly, his prayer for bail in connection with Session Trial No.458-A of 2006, arising out of Hilsa ( Karai) P.S.Case No.103 of 2005, pending in the court of 5th Additional Sessions Judge , Hilsa, Nalanda, is again rejected. However, the learned trial court is directed to conclude the trial of the petitioner as early as possible, preferably, within nine months from the date of receipt/ production of copy of this order.
Let a copy of this order be sent to Superintendent of
Patna High Court Cr.Misc. No.45366 of 2014 (4) dt.29-07-2015 2/2 police, Nalanda, with direction to him to ensure the presence of remaining prosecution witnesses of the above stated case before the court of Additional Sessions Judge 1st, Hilsa (Nalanda)/ concerned court as early as possible , failing which the matte shall be viewed seriously.
