The petitioners are apprehending their arrest in connection with Sonepur P.S.Case No.217 of 2018 daed 21.3.2018 , registered for offences punishable under Sections 304(B), 498(A)/34 of the Indian Penal Code and Sections 3 & 4 of the Dowry Prohibition Act..

Allegation against the petitioners who happen to be Gotany and the brother-in-law is of the dowry death. Submission of the learned counsel for the petitioners is that firstly no specific allegation has been alleged against any of the petitioners and secondly the husband has already been granted privilege of anticipatory bail, vide order dated

Patna High Court Cr.Misc. No.1644 of 2019(2) dt.24-01-2019 2/2 18.9.2018 passed in Cr. Misc. No.48326 of 2018. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Saran, Chapra in connection with Sonepur P.S.Case No.217 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case..

With the aforesaid observation, this application is allowed.
