The petitioner seeks bail in a case registered under sections 20 and 22 of the N.D.P.S. Act. The police raided the house of Ashutosh Chaudhary @ Ashu son of Ramesh Chaudhary and from there 50kg of Ganja was recovered. The petitioner was apprehended inside the house but Ashutosh Chaudhary managed to flee away. Learned counsel for the petitioners submits that Lalan Chaudhary, Dharmendra Pathak and and Ashish Kumar were also apprehended along with the petitioner inside the house but Lalan Chaudhary has already been enlarged on bail vide Cr. Misc. No. 3842 of 2015.-The case of the petitioner stands on the same footing.

No.5064 of 2015 (2) dt.05-02-2015 2/2 Considering the fact that Ganja was recovered from the house of Ashutosh Chaudhary and petitioner was found inside the house but nothing has been recovered from the possession of the petitioner and similarly situated co-accused has been enlarged on bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sessions Judge, Saharsa in Kishanpur P.S.
