The petitioners seek anticipatory bail in connection with Raniganj P. S. Case No. 325 of 2018, registered for offences punishable under Sections 379 and 411/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is that when the informant heard the sound and saw that one pick up van standing behind the tractor and after cutting the rope of maize loaded in the pick up van and later on, one person was apprehended, who disclosed that the pick up van belongs to Katihar.

Submission of the learned counsel for the petitioners is that the petitioners have falsely been implicated and there is

Patna High Court Cr.Misc. No.1227 of 2019(4) dt.14-02-2019 2/2 general and omnibus allegation against all the named accused persons and the petitioners have no criminal antecedents. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Raniganj P.S.Case No. 325 of 2018, to the satisfaction of learned Chief Judicial Magistrate, Araria, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
