Petitioner who is in custody seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

Informant in his written complaint has alleged that on 02.02.2019 at about 8:00 pm, four unknown miscreants entered into the shop of Informant and three remained outside and looted away the jewellery worth Rs. 1 Crore 50 Lacs from his shop.

It has been submitted on behalf of the petitioner that the name of petitioner has surfaced in this case on the basis of

Patna High Court CR. MISC. No. 30991 of 2019(4) dt.17-08-2019 2/3 confessional statement of co-accused Md. Rahmatulla @ Sahab in which he has confessed that the looted jewellery has been sold to the petitioner and except this allegation there is nothing against the petitioner to rope him in this case. It has been further submitted that the articles which is alleged to have been looted away was not recovered from the possession of the petitioner as he himself is engaged in jewellery business having shop and has been implicated in this case due to business rivalry. Petitioner is in custody since 16.02.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Hajipur Town P.S. Case No. 99 of 2019, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at
