The petitioner seeks anticipatory bail in connection with Doriganj P.S.Case No. 259 of 2018, registered for offences punishable under Sections 384 and 385 of the Indian Penal Code.

Allegation against the petitioner as per F.I.R. is that the petitioner, who happens to be the police personnel, forcefully collected money from the truck drivers and thereafter they allow to proceed the truck.

Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and no truck driver have ever made any complaint against the petitioner and the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.79686 of 2018(3) dt.19-02-2019 2/2 Learned A.P.P. opposes the prayer for bail on the ground that there is allegation against the petitioner is of demanding money for transportation of the truck that caused blockage on the road.

Having heard both sides and in view of the facts and circumstances as discussed above, the case of the petitioner is concerned, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of four weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.

This application is accordingly dismissed.
