The petitioner is in custody since 25.09.2014 in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted that the First Information Report was lodged against unknown. During investigation, suspicion has been made against the petitioner and on the basis of suspicion, the chargesheet has already been submitted. There is no chance of tampering with the evidence.
The learned counsel for the State submits that the petitioner has also criminal antecedent.
Considering the facts and circumstances of this case, the
Patna High Court Cr.Misc. No.5150 of 2015 (2) dt.06-02-2015 above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 3rd Jamui in connection with Sessions Trial No. 314 of 2014 arising out of Laxmipur (Gidhour) P.S. Case No. 56 of 2014 after framing of charge with the following conditions:
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3. The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
