JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when the court starts physical function.
Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 09.07.2020 in a case registered for the offences punishable under Sections 341, 323, 333, 353, 188, 269, 427/34 of the Indian Penal Code. Allegedly, petitioners were stopped by police officials while they were going on a bike without wearing helmet and mask and when the police asked them to wear mask and helmet, they assaulted the police party.

No.31988 of 2020(2) dt.04-12-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on provisional bail till removal of the defects on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Jhanjharpur in connection with Ghoghardiha P.S. Case No.111 of 2020.
It is made clear that if the defects, as pointed out by the office are removed within the above stated period , the provisional bail of the petitioner shall be deemed to be confirmed.
