JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-12-2020 In view of the submission and the undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 25.11.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Birpur P.S. Case No. 55 of 2020, registered under Sections 25(1-b),A, 26and 35 of the Arms Act.

The accusation is that on receiving secret information about movement of miscreants boarding on Aartika vehicle bearing registration No. DL-2CAP-3481 towards Maida

Patna High Court CR. MISC. No.31771 of 2020(2) dt.10-12-2020 2/2 Bhabhangama, the informant and other Police personnel proceeded for there. In the way, the said vehicle was seen in which three persons were sitting, who disclosed their names Rakesh Paswan (Petitioner), Sanjit Kumar and Ranjit Paswan. On search, petitioner was found in possession of one country made pistol and one android phone, whereas, Sanjit Kumar was found in possession of one line cartridge and Ranjit Paswan was found in possession of one live cartridge.

Learned counsel appearing for the petitioner submits that petitioner has no criminal antecedent and he has falsely been implicated in this case showing recovery of one country made pistol. Further submission is that petitioner is in custody since 01.06.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVI, Begusarai in connection with Birpur P.S. Case No. 55 of 2020. One surety must be parents/close relative of the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
