In both the aforesaid petitions petitioners, who are in custody in connection with Naubatpur P.S. Case No.202 of 2014 registered for the offence under Section 365 of the Indian Penal
Patna High Court Cr.Misc. No.44773 of 2014 (4) dt.04-02-2015 2/2 Code and subsequently converted to Section 364 / 120 B of the Indian Penal Code, have prayed for grant of bail, and as such, both petitions were heard together and are being disposed of by this common order.
The F.I.R. was lodged against unknown and learned counsel for the petitioners submits that only on suspicion and some circumstantial evidence, the petitioners have been implicated in the present case and they are in custody since the month of May, 2014.
Keeping in view the nature of accusation and the facts of the case, the court is of the opinion that it is a fit case for extending the privilege of bail.
Let both the petitioners namely Jainendra Kumar and Alok Kumar Sinha @ Alok Kumar Singh be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Uma Shankar, Judicial Magistrate Ist Class, Danapur, Patna and A.C.J.M., Danapur respectively in connection with Naubatpur P.S. Case No. 202 of 2014.
