02-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in K.Nagar P.S. Case No. 84 of 2021, arising out of Special Case No. 17 of 2021 / C.I.S. No. 17 of 2021 (N.D.P.S. Act), registered for the offence under Sections 8 / 21 / 22 (B)(c) of the N.D.P.S. Act. On a secret information that some narcotics drugs are being transported, a raid was conducted and five accused persons were arrested from a Swift Dezire Car and on search, one kg. 500 gm. of Brown Sugar was recovered and the apprehended co-accused persons disclosed that aforesaid Brown Sugar was to be delivered to this petitioner. It is submitted on behalf of petitioner that nothing has been recovered either from the possession or from the house of

Patna High Court CR. MISC. No.43756 of 2021(2) dt.02-11-2021 2/2 the petitioner. Recovery has been effected from the possession of other co-accused persons, who were apprehended on spot. Petitioner has been named in this case only on the basis of confessional statement of apprehended co-accused persons. Petitioner is in custody since 03.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as the fact that no narcotic drug has been recovered either from the possession or from the house of petitioner and chargesheet has been submitted, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S. Act, Purnea in connection with K.Nagar P.S. Case No. 84 of 2021, arising out of Special Case No. 17 of 2021 / C.I.S. No. 17 of 2021 (N.D.P.S. Act).
