2. The petitioner makes a prayer for grant of regular bail in a case registered under sections 25(1-b), A,26,35 of the Arms Act.
3. The allegation in the FIR, is based upon a viral video in which some persons were seen in possession with the illegal arms. On seeing the same, the informant along with the police force reached on the spot and upon chase three of the persons were apprehended from the place of occurrence and from their possession one country made pistol was recovered and the apprehended person disclosed the name of their other associates.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.32926 of 2025(2) dt.22-05-2025 2/2 petitioner was not arrested on the spot and the name of the petitioner surfaced in the confessional statement of the apprehended co-accused before the police, which has no evidentiary value. As a matter of fact, nothing has been recovered from possession of the petitioner and rather one country made pistol and a bullet was recovered from one coaccused Sudhanshu Kumar. Three of the accused persons have already been granted bail by the learned court below. The petitioner is in custody since 20.01.2025 with no criminal antecedent and charge sheet has been submitted in this case.
5. The learned APP opposes the prayer for bail of the petitioner.

Taking into consideration the facts and circumstances of the case, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Begusarai in connection with Bhagwanpur P.S.Case No. 270 of 2024.
