JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks regular bail as he is in custody since 06.08.2014 in a case registered for the offence punishable under Sections 147, 148, 149, 447, 341, 323, 324, 307, 302/506 of the Indian Penal Code.

As per the prosecution case, the accused persons killed the son of the informant and they also attempted to kill the informant and his wife after having formed unlawful assembly. Learned counsel for the petitioner referring to the First Information Report, submits that no assault is attributed to the petitioner on the deceased. Patna High Court Cr.Misc. No.9392 of 2015 (2) dt.03-03-2015 examination of the informant, learned counsel for the petitioner submits that the injuries are not grievous. It has been stated in paragraph No. 3 of the application that the petitioner has no criminal antecedent.

In view of the above, let the petitioner Azam, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Barhariya (G.B. Nagar) P. S. Case No. 304 of 2014.
