====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 05-06-2025 No one appears on behalf of the petitioners, even after repeated calls. However, learned APP for the State is present.

2. The petitioners seek regular bail in connection with Nasariganj P.S. Case No. 424 of 2024 lodged on 22.12.2024 under Sections 109, 61(2), 351(2), 3(5), 118(2), 326(g), 324(4), 324(5) of the BNS, 2023.

As per the prosecution, F.I.R. has been lodged against six named accused persons, alleging that they assaulted the informant and her family members, as a result of which her husband and son sustained injuries. In this regard, a criminal case was filed on 19.12.2024, in which three persons were taken into custody. Subsequently, the accused persons, along with coaccused, again went to the house of the informant and burned her hut, causing further injuries to her husband and son, whose

It has also been alleged that the animals kept in the hut were burnt in the incident, resulting in a loss of Rs. 4,00,000/-, and the accused further threatened to kill the informant and her family members.

4. It transpires from the pleadings that petitioner No. 1 and the informant are jija and saali, and petitioner Nos. 2 and 3 are bhatija of the informant. It further transpires from the pleadings that there is a previous enmity between both parties, as it has been mentioned in the F.I.R. that a case has already been lodged against the petitioners, bearing Nasriganj P.S. Case No. 421 of 2024. It has also been pleaded in the petition that a Title Suit, bearing Title Suit No. 538 of 2023, is pending between both parties, i.e., the informant's side and the petitioners' side, before the Sub-Judge - I, Bikramganj, Rohtas, and a land dispute is ongoing among the family members. It has been further pleaded that Mutation Case No. 1376 of 2023-24 was decided in favour of the petitioners on 04.11.

2024, and as soon as the informant received information about the outcome of the said mutation case, the present F.I.R. was filed against the petitioners. It also transpires from the pleadings that the petitioners have been in custody since 02.01.

5. Learned APP for the State opposes the prayer for bail but fairly submits that it transpires from the pleadings that the dispute is between two sisters and their respective family members. The informant, Binda Devi, is the daughter of Kamal Kishore, while one of the petitioners is the husband of Chinta Devi, who is also a daughter of Kamal Kishore. Thus, the dispute appears to be related to the property of Kamal Kishore and is ongoing between the two sisters, their husbands, and other family members.

In this background, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nasariganj P.S. Case No. 424 of 2024, subject to the following conditions as laid down under Section 480(3) of the BNSS.
