JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 17.8.2014 in a case registered for the offences punishable under Sections 307 and 353/34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the police raided the place on information that the miscreants are preparing to commit some serious offence when the bomb was exploded. The petitioner was apprehended from the spot and from his possession one loaded country made pistol, three live cartridges and mobile were recovered.

It is submitted by the learned counsel for the petitioner that for the recovery of arms, Bhagwanpur P.S. Case No. 191 of

Patna High Court Cr.Misc. No.6490 of 2015 (2) dt.19-02-2015 2014 under sections 399/402 IPC and 25(1-B)a, 26 and 35 of the Arms Act has been registered. Admittedly, no injury has been caused to the informant and two cases for the same occurrence have been lodged. Statement has been made in paragraph 3 of the petition that the petitioner has been made accused in one case, referred to above.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Siwan in connection with Bhagwanpur P.S. Case No. 192 of 2014.
