JUSTICE DINESH KUMAR SINGH ORAL ORDER 04/ 09-03-2016 The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 20, 22, 23 and 24 of the NDPS Act. The petitioner is languishing in custody since 01.12.2012.

70 kgs. of Ganja were recovered from the hutment of the petitioner.

It is submitted by learned counsel for the petitioner that the recovery has been made from a deserted hut, hence, it cannot be treated to be a recovery from his possession. The report of the S.P., East Champaran at Motihari dated 25.02.2016 reflects that out of five witnesses four have been examined and the last witness Suresh Rai is expected to

Patna High Court Cr.Misc. No.6900 of 2015 (04) dt.09-03-2016 2/2 be examined on 10.03.2016.

Considering the present stage of the trial, this Court is not inclined to interfere.

It is expected from learned 1st Additional Sessions Judge, Motihari, East Champaran to conclude the trial of NDPS Case No. 154 of 2012 arising out of Raxaul P.S. Case No. 302 of 2012 expeditiously.

It is expected from the S.P., East Champaran, Motihari to produce the last witness on the next date, if he has not been produced till date.
