2. The petitioner has prayed for bail in connection with Mirganj P.S. Case No. 99 of 2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. The case of the prosecution is that from a Ford car bearing registration no. BR28Z3708, 1159 tetra pack of 200 ml and other tetra packs, altogether 231.800 liters of country-made foreign liquor was recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. She has been falsely implicated in this case. It has also been submitted that two persons were standing
Patna High Court CR. MISC. No.33194 of 2025(2) dt.22-05-2025 2/2 there, Kalawati Devi, who is the petitioner is one of them. Petitioner has got no concern with the alleged recovery and the vehicle. He next submits that petitioner has got clean antecedent as stated in para-3 of the bail petition. Petitioner is languishing in judicial custody since 03.03.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV-cum-Exclusive Special Excise Court-II, Gopalganj in connection with Mirganj P.S. Case No. 99 of 2025.
