JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-02-2015 Learned counsel is permitted to make necessary correction in paragraph one of the bail applications. Heard Shri Rana Pratap Singh learned senior counsel appearing for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code and SC/ST Act and 27 of the Arms Act.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected by this court vide order dated 15.05.2014. It is submitted that the charges have been framed but till date not a single witness has been examined.
Patna High Court Cr.Misc. No.7131 of 2015 (2) dt.20-02-2015 2/2 Considering the fact that there is allegation against the petitioner along with three other persons that they indiscriminately fired causing the death of two persons belonging to Scheduled Caste, I am not inclined to enlarge the petitioner on bail at this stage. The same is rejected. It appears that the petitioner is in jail since 07.10.2013. Petitioner has already remained in jail for more than a year but not a single witness has been examined. The Ist Additional District Judge, -cum-Special Judge, Sitamarhi is directed to take all efforts for conclusion of the trial within one year from the date of receipt of the order. The Superintendent of Police , Sitamarhi is also directed to produce all the witnesses in court so that the trial may be concluded on day to day basis.
Let a copy of this order be sent through fax to the learned court below as well as the Superintendent of Police Sitamarhi for compliance.
