The petitioner is apprehending his arrest in connection with Basnahi P.S.Case No.13 of 2018 , registered for offences punishable under Sections 341, 323, 504 of the Indian Penal Code.
Petitioner happens to be informant of the case and the allegation as per the FIR is that he found one Nakul Kumar in suspicion condition and with the help of the villagers he was apprehended and one loaded country-made pistil has been recovered form him and it appears that later on on the statement of Nakul Kumar and his family members petitioner has been made accused and there is allegation that he has been falsely implicated by Nakul Kumar due to enmity between the parties. Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.79199 of 2018(3) dt.01-03-2019 2/2 that he has been falsely made accused in this case rather FIR has been lodged at his instance and he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM III, Saharsa in connection with Basnahi P.S.Case No.13 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
