The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(A) and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2018. It is a case of recovery of about 5800 liters of illicit liquor from a truck.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not been arrested at the spot. He further submits that petitioner has no concern with the seized vehicle.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Patna High Court CR. MISC. No.42549 of 2021(3) dt.24-03-2022 2/2 From perusal of the supplementary affidavit, it appears that the petitioner has criminal antecedent in four cases of similar nature, as such, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail is rejected.
