JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 05-02-2019 The appellant seek pre arrest bail in connection with Chand P.S. Case No. 02/2018, registered for offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act and Section 3(2) (V) of SC/ST Act. Allegation against the appellant is of firing causing death of the deceased.

It has been submitted on behalf of the appellant that the police after investigation has submitted final form, however, cognizance has been taken against the appellant. Learned Special P.P. opposed the prayer for bail. Having heard both sides, from perusal of the impugned order it appears that learned ACJM -IV, Kaimur at Bhabhua has taken cognizance against the appellant differing with the police

Patna High Court CR. APP (SJ) No.4821 of 2018 dt.05-02-2019 2/2 and he has given a reasoned order for the same, in such view of the matter, I am not inclined to grant privilege of pre arrest bail to the appellant rather he should surrender before the court below and pray for regular bail, which will be disposed of on the merit of the case, without being prejudiced by the order of this Court. Accordingly, this appeal is dismissed.
