JUSTICE PRABHAT KUMAR JHA ORAL ORDER 04-01-2021 Learned counsel for the petitioner submits that petitioner filed supplementary affidavit making prayer for correction in the prayer portion of the bail petition. It is submitted that case is pending before the S.D.J.M.(West), Muzaffarpur but due to inadvertence, Special Judge, Excise Act, Muzaffarpur has been typed in the prayer portion. In this view of the fact, learned counsel for the petitioner is permitted to make correction in the prayer portion of the bail petition.
Heard both sides.
The petitioner seeks bail in Kanti P.S. Case No.493 of 2014 registered under Section 307 of the Indian Penal Code and under Section 27 of the Arms Act.
The informant lodged the case against unknown
Patna High Court CR. MISC. No.33361 of 2020(3) dt.04-01-2021 2/2 alleging therein that while he was returning to his house, somebody opened firing causing injury in his back and chest and he fell down from the motorcycle.
The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of co-accused Gautam Kumar. Save and except the confessional statement of Gautam Kumar, the investigating officer did not collect any further material to show the involvement of the petitioner. Gautam Kumar is alleged to have stated that the petitioner fired but except the confessional statement, there is no tangible material. Petitioner is in jail since 25.04.2020. Taking into consideration the facts aforesaid and the fact that petitioner is in jail since 25.04.2020, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M.(West), Muzaffarpur in connection with Kanti P.S. Case No.493 of 2014.
