JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rajeev Nagar P.S. Case No. 200 of 2017 registered for the offences punishable under Sections 420, 467, 406, 468, 471 and 120B of the Indian Penal Code. Allegation as per FIR is that co-accused Arbind Kumar has committed fraud and taken away the money from the different persons and fled away and petitioner happens to be his friend and a cheque has been deposited in his account. Submission of learned counsel for the petitioner is that specific allegation is against Arbind Kumar and there is no allegation against the petitioner that he has taken money and other co-accused persons have been granted anticipatory bail by this Court vide order dated 24.1.2019 in Cr. Misc.No. 1694 of 2019.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna, in connection with Rajeev Nagar P.S. Case No. 200 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
