JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Mithanpura P.S. Case No. 59 of 2020 registered for the offence punishable under Sections 392, 395 and 412 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is in custody since 20.04.2020. The F.I.R. was registered against unknown with the allegation that the miscreants had snatched the informant's bag containing cash of Rs. 5,00,000/-. During the course of investigation, on the basis of confessional statement of co-accused, the petitioner's name has surfaced, who at that point of time was in custody in connection with some other case and was remanded in the

Patna High Court CR. MISC. No.32291 of 2020(4) dt.05-02-2021 2/2 present case.

Learned counsel appearing on behalf of the petitioner has submitted that the co-accused Prakash Kumar has been allowed regular bail by this Court by an order dated 11.11.2020 passed in Cr. Misc. No. 28833 of 2020. He has submitted that since charge sheet has been submitted, no purpose would be served by compelling the petitioner to remain in custody any further.

Considering the fact that the petitioner is in custody since 20.04.2020 and a co-accused in similar circumstances has been allowed regular bail, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (East), Muzaffarpur in Mithanpura P.S. Case No. 59 of 2020.
