JUSTICE AMARESH KUMAR LAL ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 7 of Essential Commodity Act. Considering the facts that the petitioner is not a P.D.S. dealer and there is no any specific monogram of F.C.I. on the bag which was recovered from the possession of the petitioner and the petitioner has no criminal antecedent, let the petitioner Chhotelal Sah, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Bagaha (West Champaran) in connection with Gobardhana P. S. Case No. 08 of 2014 with following conditions:-

Patna High Court Cr.Misc. No.5325 of 2015 (2) dt.09-02-2015 2/2 I) One of the bailors will be the close relative of the petitioner.

II) The petitioner will not indulge in similar or in any other offence.

III) The petitioner will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
