Petitioner seeks bail in connection with Bikram P.S. Case No. 97 of 2013 registered for the offences punishable under Sections 147, 148, 149, 323, 325, 307, 233, 353 and 201 of the Indian Penal Code.
Allegedly, when the excise officials conducted raid, the villagers including the petitioner attacked on the excise officials and torn the seizure list and further damaged the government vehicle. Six Police officials were injured. Submission is that there is no specific allegation against the petitioner, he has been named with oblique motive and he is suffering in custody since 11.1.2014. The injuries found are
Patna High Court Cr.Misc. No.44003 of 2014 (3) dt.16-02-2015 simple in nature, and as such, the petitioner deserves sympathetic consideration to which the learned APP opposes. In the facts and circumstances stated above, in this case chargesheet has already been submitted and there is no chance of tempering with the prosecution evidence and further considering the period of detention, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Mahavir Prasad, J. M. Ist Class, Danapur, Patna in connection with Bikram P.S. Case No. 97 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
