====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Rajapakar P.S. Case No. 136 of 2018, instituted for the offence under Section(s) 399, 402, 307, 120(B), 414/34 of the Indian Penal Code, Sections 25(1-b)a, 27 and 35 of Arms Act.

Counsel for the petitioner submits that co-accused Sonu Kumar has already been granted bail by this Court vide order dated 23.01.2019 passed in Cr. Misc. 76407 of 2018. It is alleged in the written report that informant got information that members of gang armed with weapons have come in Chaur situated in the village Rampul Dilawar to commit dacoity. It is further alleged that informant arrested this

Patna High Court CR. MISC. No.31428 of 2019(2) dt.10-05-2019 2/2 petitioner along with other accused as named in the written report. It is mentioned in the written report that different articles have been recovered from possession of other apprehended persons.

From the written report itself it appears that there is no recovery of any incriminating article from possession of the petitioner.

Petitioner is in custody since 8.8.2018.

Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Vaishali at Hajipur, in connection with Rajapakar P.S. Case No. 136 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
