The petitioner seeks bail in Shikarpur P.S. Case No. 322 of 2014 registered under section 302 and other allied sections of the Indian Penal Code.

The son of the deceased alleged that while his father was returning from the Chowk accused Guddu @ Sumser Mahto, Suresh Kumar Ghuran Mahto and Asha Devi surrounded his father. Asha Devi is alleged to have caught the cycle of Bindyachal Sah. Bindhyachal Sah fell down on the ground. Accused Samsher Mahto brutally assaulted Bindhyachal Sah. It appears that there is no allegation of assault against petitioner Asha Devi. Earlier husband of the petitioner

Patna High Court Cr.Misc. No.5330 of 2015 (2) dt.09-02-2015 2/2 filed Shikarpur P.S. Case no. 360 of 2014 against Sila Devi and others.

Considering the fact that there is no allegation of assault against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in Shikarpur P.S.
