The petitioner is apprehending his arrest in connection with Ballia P.S.Case nO.37 of 2018 registered for offences punishable under Sections 420, 406, 382/34 of the Indian Penal Code.

Allegation as per Fir is that two accused persons hired pick up van of the informant for carrying potatoes and thereafter snatched money and taken away the pickup van and the petitioner is not named in the FIR and later on his name transpired during the course of the investigation of the case and it further appears that the petitioner is accused in four other cases.

Submission of the learned counsel for the petitioner is that his name transpired on the supervision note at the instance

Patna High Court Cr.Misc. No.1570 of 2019(2) dt.23-01-2019 2/2 of the police and earlier also he had been made accused at the instance of the police and he is ready to abide by any condition imposed upon him.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
