The petitioner seeks bail in connection with Sohsarai P.S. Case No. 170 of 2024 instituted for the offence under Sections 310(2), 317(3) & 317(5) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case in short is that six - seven miscreants entered into the house of the informant by breaking the door and with the help of pistol, looted about Rs. 15 lakhs and ornaments valued at Rs. 30-32 lakhs.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25-07-2024. Petitioner

Patna High Court CR. MISC. No.33899 of 2025(5) dt.29-08-2025 2/3 bears four criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of coaccused. Nothing has been recovered from the possession of the petitioner. Charge sheet has already been submitted in this case. Other co-accused has been granted bail by this Court vide order dated 13-05-2025, passed in Cr. Misc. No. 14712 of 2025. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is fervently contended that petitioner was identified in the T.I. Parade. Moreover, there is recovery of 3.10 Lakh cash, silver anklet and one golden chain from the possession of co-accused person, including the petitioner.

Considering the aforesaid facts and circumstances of the case, there being recovery from the petitioner's possession and petitioner being identified in the T.I.Parade, this Court at this stage is not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected. 8.

However, petitioner will be at liberty to renew his
