JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-04-2019 The petitioner apprehends his arrest in connection with Khagaria (Muffasil) P.S.Case No. 524 of 2018 registered under Sections 307 and 504 of the Indian penal Code and 27 of the Arms Act.

Allegation as per FIR is that on hearing sound of firing, the informant woke up and saw his wife in injured condition having firearm injury and he suspected the hand of the petitioner as earlier he has threatened to kill him and his wife. Submission of learned counsel for the petitioner is that except suspicion there is nothing against him and even during investigation there is no eye witness to the occurrence even there is no incriminating circumstances against him and he has no criminal antecedent.

Having heard both sides and in the facts and

No.80077 of 2018(5) dt.15-04-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria (Muffasil) P.S.Case No. 524 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
