2. The petitioner has prayed for regular bail in connection with a case registered for the offences punishable under Sections 84, 303(2) and 3(5) of the BNS.
3. The case of the prosecution, in brief, is that the petitioner allegedly abducted the wife of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that, as per the F.I.R., the alleged occurrence took place on 18.01.2026, whereas the F.I.R. was instituted on 25.02.2026, i.e., after a delay of more than 25 days, for which no plausible explanation has been furnished. It is further submitted that during the course of investigation, the
Patna High Court CR. MISC. No.32328 of 2026(2) dt.13-05-2026 2/2 victim was recovered and in her statements recorded under Sections 180 and 183, she stated that the petitioner had abducted her. Learned counsel further submits that the petitioner is aged about 19 years, whereas the victim is aged about 26 years. It has also been submitted that the victim is addicted to intoxicants and the petitioner came into her contact on account of his habit of consuming intoxicants. Moreover, the petitioner is languishing in judicial custody since 05.03.2026 and has no criminal antecedent.
5. Learned APP appearing for the State has opposed the prayer for regular bail.
6. Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. Accordingly, the above-named petitioner is directed to be released on bail in connection with Forbesganj P.S. Case No. 101 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
