The petitioner seeks regular bail in a case registered under Sections 272, 273, 420, 467, 120B, 34 of the Indian Penal Code and Section 47(A)(E)(F) of the Excise Act. The police got information that in the house of Santosh Yadav, illicit liquor was being prepared and, on such, a raid was conducted and huge quantity of country-made liquor and other articles were recovered.
Learned counsel for the petitioner submits that the petitioner is the brother of Santosh Yadav. He has already been separated from his brother and is residing in another house. On the other hand, learned A.P.P. has submitted that the petitioner is the brother of Santosh Yadav and he is involved in
Patna High Court Cr.Misc. No.5832 of 2015 (2) dt.12-02-2015 2/2 illegally preparing country-made liquor.
It appears from the seizure list that the house of Santosh Yadav was raided from where huge quantity of countrymade liquor and other articles were recovered. The petitioner, being the brother of Santosh Yadav, is in jail since 09.12.2014. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Nawanagar (Sonbarsha) P.S.
