JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-04-2019 In view of the fact that the respondents have produced the judgments dated 02.02.2017 and 17.08.2015 passed in L.P.A. no. 2185 of 2015 and C.W.J.C. no. 12390 of 2015, whereby and whereunder the learned Division Bench and a co-ordinate Bench of this Court have held that the selection or engagement or hiring of the Tola Sewak is not a permanent appointment in the State, hence no writ petition is maintainable under Article 226 of the Constitution of India, the learned counsel for the petitioners seeks to withdraw the present writ petition with liberty to the petitioners to approach the authorities for redressal of their grievances.
Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioners to avail such other remedies as are available under the law.
