Petitioner apprehends his arrest in connection with Araria (R.S.) P.S. Case No.246 of 2019 dated 25.03.2019, registered for the offence punishable u/s 147, 148, 149, 341, 323, 324, 307, 353 of the IPC, 30(a), 38, 41(1) of Bihar Prohibition and Excise Act, 2016 and 27 of the Arms Act, pending in the Court of learned Exclusive Special Judge, Excise-I, Araria. 3.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the

Patna High Court CR. MISC. No.38270 of 2023(2) dt.01-08-2023 2/2 learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application.
