This application for regular bail arises out of Bachhwara P.S. Case No. 45 of 2020, disclosing offence punishable under Sections 188, 120-B of the Indian Penal Code and Sections 30(a), 32(2) and 41(2) of Bihar Prohibition and Excise Act, 2016.

It is the case of the prosecution that the police recovered 94.560 litres of India-made foreign liquor and 348 litres of beer, on the basis of a secret information that coaccused Chunnu Yadav had brought large consignment of illicit liquor which was kept in a truck and that the petitioner and other co-accused persons were trying to unload the liquor. Except for the secret information that the petitioner

Patna High Court CR. MISC. No.31585 of 2020(2) dt.03-12-2020 2/2 was engaged in unloading of the illicit liquor from the truck with others, there is no other material against the petitioner. The petitioner is in custody since 11.07.2020.

Considering the nature of allegation, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise, Begusarai, in Bachhwara P.S. Case No. 45 of 2020. It is directed that defects in the application pointed out by the Registry must be removed within two months from today. (Chakradhari Sharan Singh, J) Rajesh/- U T
