The petitioner is accused in connection with Bikram P.S. Case No. 74 of 2014 registered under Sections 302, 120(B) and 34 of the Indian Penal Code.
The allegation of informant is that marriage of his sister was solemnized with one Sumant Kumar, son of the petitioner, on 18.04.2000 and she has one son and one daughter from her wedlock but she was being tortured by her husband and in-laws family members, as her husband wants to perform remarriage. Lastly, his sister was killed by pouring kerosene oil on her body and dead body was disposed of by her in-laws family members.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.4577 of 2015 (3) dt.04-03-2015 2/2 submits that petitioner is father-in-law of the deceased. Admittedly, the incident took place after 14 years of the marriage. In fact, the deceased was of short tampered and due to some quarrel in relation to the domestic work, she committed suicide herself by burning. Thereafter, the dead body of the deceased was cremated at Bansghat but due to ulterior motive after four days, the informant has lodged the present case. It is also submitted that the police after investigation, submitted the charge-sheet under section 306 of the I.P.C. It is further submitted that petitioner, being father-in-law of the deceased, has already himself surrendered and is in custody since 18.11.2014.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Danapur, Patna in connection with Bikram P.S. Case No. 74 of 2014. Out of two sureties, one surety must be the parents/close relatives of the petitioner.
