The petitioner is languishing in custody since 02.11.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Informant reached to his village home after receiving information of death of his father and found the dead body of his father in the room with injuries on the ear. Suspicion was raised against the petitioner since there was land dispute between the petitioner and the father of the informant as the petitioner happens to be uncle of the deceased. It is submitted by learned counsel for the petitioner that only on suspicion due to the litigated relationship

Patna High Court Cr.Misc. No.5852 of 2015 (02) dt.12-03-2015 2/2 between the petitioner and the father of the informant suspicion was raised against the petitioner and except suspicion there is no direct material collected by the investigating agency against the petitioner.

Considering the suspicion nature of accusation, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate (West), Muzaffarpur in connection with Motipur P.S. Case No. 351 of 2014.
