JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This is an application for grant of anticipatory bail in connection with Mohania P.S. Case No. 521 of 2018, disclosing offences under Sections 147, 149, 353, 379, 511, 337 of the Indian Penal Code.

Allegation as per F.I.R. is that police went to arrest one co-accused Raju Kumar, thereafter two other persons started Hulla of dacoit and thereafter villagers assembled and try to get the accused person flee.

Submission of learned counsel for the petitioners is that no specific allegation has been attributed against them and have falsely been implicated in this case. Further, they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Mohania P.S. Case No. 521 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
