The petitioner seeks bail in Session Trial No. 762 of 2013 arising out of Daniyawan P.S. Case No. 04 of 2013 registered for the offences under Sections 489A, 489B, 489C and 420 read with Section 34 of the Indian Penal Code.
The prayer for bail of the petitioner has been rejected twice by this Court vide orders dated 09.10.2013 and 27.06.2014 passed in Cr. Misc. No. 20855 of 2013 and Cr. Misc. No. 13860 of 2014 respectively.
Learned counsel for the petitioner submits
Patna High Court Cr.Misc. No.8555 of 2015 (2) dt.11-03-2015 that by now the petitioner has remained in custody for more than two years and the trial of the case is at an early stage. Till date only charges have been framed. Be that as it may, for the reasons assigned in my order dated 09th October, 2013 passed in Cr. Misc. No. 20855 of 2013, I am not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail is rejected. However, since the petitioner is in custody for over two years, the learned Additional Sessions Judge I, Patna City is directed to expedite the trial and conclude the same as early as possible.
