JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 38(a), 38(i) of Bihar Excise and Prohibition Act, 2018.

Several bottles containing Indian made foreign liquor were recovered from a tempo. Petitioners were found sitting in the aforesaid tempo and accordingly, they were caught by the police. Petitioners do not have any criminal antecedent and are languishing in jail custody since 26.02.2019. Considering the aforesaid facts and circumstances as
