JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was Chairman of PACS at the relevant time and accusation against him is that he did not make payment of paddy to one Dr. Birendra Singh and Bansh Ropan Singh and accordingly, he defalcated amount of Rs. 16,55,940/- Learned counsel for the petitioner drew my attention towards page 21 and 22 of the petition and submits that the cheques were prepared in the name of Bansh Ropan Singh and Dr. Birendra Singh respectively and the aforesaid persons received the cheques but they did not produce the said cheques before the concerned bank which is evident from perusal of letters of bank annexed at page 25 and 26 of the petition. Moreover, up till now, the aforesaid cheques were not encashed.

No.7832 of 2015 (2) dt.26-02-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Kaimur at Bhabua in connection with Nuaon (Ramgarh) P.S.
