JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Ratanpura P.S. Case No. 65 of 2018 dated 10.11.2018 instituted for the offences under Section 420 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
630.90 litres of liquor is said to have been recovered from a Scorpio vehicle of which the petitioner is stated to be the owner.
The learned counsel for the petitioner has submitted that the vehicle in question was given by the petitioner to the driver to ply the same commercially and the driver in this instance has played truant.

No.79285 of 2018(2) dt.28-01-2019 2/2 Regard being had to the aforesaid facts and taking into account that petitioner has fair antecedents, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge, 2nd cum Special Judge, Excise Act, Supaul in connection with Ratanpura P.S. Case No. 65 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
