Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Maker P.S. Case No. 45 of 2019, instituted for the offence under Section(s) 414 of the Indian Penal Code.
It is alleged in the written report that during course of vehicle checking, the petitioner was arrested by the Police along with one Apache Motorcycle. He could not produce paper of the aforesaid Motorcycle on demand. He disclosed that alleged Motorcycle was given to him by Pritam Singh. Counsel for the petitioner submits that Pritam Singh
Patna High Court CR. MISC. No.31811 of 2019(3) dt.16-07-2019 2/2 has never claimed aforesaid Motorcycle. He further submits that no case has been lodged with regard to theft of the aforesaid Motorcycle by its owner.
Petitioner is in custody since 18.3.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 12th Saran, Chapra, in connection with Maker P.S.
